The Procurement Entities HUS Group (later also ”HUS”) and ISLAB hereby requests tenders for genetic testing for rare diseases using various methods. The procurement includes the following tests: 1. Ataxia repeat analysis by NGS 2. Repeat expansion analysis (UGT1A1) 3. Repeat expansion analysis (CANVAS) 4. Repeat expansion analysis (MUC1) 5. Genetic testing for hereditary Alpha Tryptasemia 6. MLH1 promoter methylation analysis 7. Beckwith-Wiedemann syndrome testing 8. Cystic fibrosis (CF-EU2) 9. Long-range PCR analysis of CYP21A2 10. Long-range PCR analysis of PKD1 and PKD2 11. Long-range PCR analysis of PMS2 12. Long-range PCR analysis of SBDS 13. Genetic testing for facioscapulohumeral muscular dystrophy (FSHD1 and FSHD2) 14. Chromosomal breakage test (Fanconi anemia) 15. Relative telomere length analysis 16. X inactivation test 17. Genetic testing for haemoglobinopathies 18. Germline episignature, DNA methylation pattern testing for specific genetic disorders 19. Sanger sequencing/ Long-range PCR analysis of the VWF gene 20. Retinoblastoma genetic screening. The procurement is divided into lots so that each test is an independent part of the procurement. A tenderer may submit a tender for one or more lots. Two (2) tenderers will be selected as the service providers for each lot if that number of tenders meeting the requirements are received. The service providers shall be chosen based on the award criteria stated in this notice. In addition to the lots described above, the tenderer may, if desired, offer other genetic tests as a voluntary option under the conditions described in this call for tenders. The subject-matter of the procurement and the mandatory requirements of it are described in detail in this call for tenders and in its attachments. A separate contract shall be conducted in writing with each chosen service provider after this tender procedure. The terms of the contract follow the terms stipulated in this call for tenders. The contract will continue until terminated.

Menettelyn tärkeimmät piirteet:

The procurement procedure is an open procedure in accordance with Section 109 of the Finnish Act on Public Procurement and Concession Contracts (1397/2016, "Procurement Act"), where any tenderer can participate in. Section 96 of the Procurement Act regarding abnormally low tenders applies to this procurement. The procedure is as follows: Procurement Entity will: 1. open tenders 2. verify answers given to the suitability requirements 3. verify tender's compliance with call for tenders After that, the Procurement Entity may 4A. conduct a tender comparison, or 4B. proceed to the negotiation procedure. The negotiation procedure may be proceeded to if: A. no tenders have been received in the tender in accordance with the call for tenders; B. no tenders can be accepted due to too high a price or other reason; or C. the Procurement Entity deems it necessary to negotiate the details of the tenders. The Procurement Entity may decide to proceed to the negotiation procedure with one, several or all sub-areas of the procurement. In other sub-areas the comparison of tenders is conducted on the base of the original tenders. All tenderers who have submitted a tender by the deadline and who meet the conditions regarding the suitability of the tenderer described in this call for tenders will be invited to the negotiations. The aim of the negotiations is to update the original call for tenders so that the tenderers selected for the negotiations can submit new tenders based on it. The negotiations will be conducted equally with all invited tenderers for a period determined by the Procurement Entity. After the negotiations, the Procurement Entity will submit an updated call for tenders to all tenderers who participated in the negotiations, on the basis of which the tenderers will submit new tenders. After this, the procurement procedure continues from point 1 described above based on the new call for tenders. After the tender comparison has been conducted, the Procurement Entity will: 5. request the winning tenderers to submit reports and other documents related to the suitability requirements 6. make a procurement decision 8. sign agreements with the chosen tenderers.

Menettelyn tärkeimmät piirteet

The economic operator is in any analogous situation like bankruptcy arising from a similar procedure under national laws and regulations.

The economic operator itself or any person who is a member of its administrative, management or supervisory body or has powers of representation, decision or control therein has been the subject of a conviction by final judgment for corruption, by a conviction rendered at the most five years ago or in which an exclusion period set out directly in the conviction continues to be applicable.

The economic operator is in arrangement with creditors.

The economic operator itself or any person who is a member of its administrative, management or supervisory body or has powers of representation, decision or control therein has been the subject of a conviction by final judgment for participation in a criminal organisation, by a conviction rendered at the most five years ago or in which an exclusion period set out directly in the conviction continues to be applicable.

Any person who is a member of the economic operator’s administrative, management or supervisory body or has powers of representation, decision or control therein has been the subject of a conviction by final judgment for work safety offence, working hours offence, work discrimination, extortionate work discrimination, violation of the right to organise or unauthorised use of foreign labour.

The economic operator is aware of any conflict of interest, as indicated in national law, the relevant notice or the procurement documents due to its participation in the procurement procedure.

The economic operator or an undertaking related to it has advised the contracting authority or contracting entity or otherwise been involved in the preparation of the procurement procedure.

The economic operator is guilty of grave professional misconduct.

The economic operator has experienced that a prior public contract, a prior contract with a contracting entity or a prior concession contract was terminated early, or that damages or other comparable sanctions were imposed in connection with that prior contract.

The economic operator has breached its obligations in the field of social law.

The economic operator has breached its obligations relating to the payment social security contributions, both in the country in which it is established and in Member State of the contracting authority or contracting entity if other than the country of establishment.

The business activities of the economic operator are suspended.

The economic operator has breached its obligations relating to the payment of taxes, both in the country in which it is established and in Member State of the contracting authority or contracting entity if other than the country of establishment.

The economic operator itself or any person who is a member of its administrative, management or supervisory body or has powers of representation, decision or control therein has been the subject of a conviction by final judgment for terrorist offences or offences linked to terrorist activities, by a conviction rendered at the most five years ago or in which an exclusion period set out directly in the conviction continues to be applicable.
