The procurement procedure is an open procedure in accordance with Section 109 of the Finnish Act on Public Procurement and Concession Contracts (1397/2016, "Procurement Act"), where any tenderer can participate in. Section 96 of the Procurement Act regarding abnormally low tenders applies to this procurement.
The procedure is as follows:
Procurement Entity will:
1. open tenders
2. verify answers given to the suitability requirements
3. verify tender's compliance with call for tenders
After that, the Procurement Entity may
4A. conduct a tender comparison, or
4B. proceed to the negotiation procedure.
The negotiation procedure may be proceeded to if:
A. no tenders have been received in the tender in accordance with the call for tenders;
B. no tenders can be accepted due to too high a price or other reason; or
C. the Procurement Entity deems it necessary to negotiate the details of the tenders.
The Procurement Entity may decide to proceed to the negotiation procedure with one, several or all sub-areas of the procurement. In other sub-areas the comparison of tenders is conducted on the base of the original tenders.
All tenderers who have submitted a tender by the deadline and who meet the conditions regarding the suitability of the tenderer described in this call for tenders will be invited to the negotiations. The aim of the negotiations is to update the original call for tenders so that the tenderers selected for the negotiations can submit new tenders based on it. The negotiations will be conducted equally with all invited tenderers for a period determined by the Procurement Entity. After the negotiations, the Procurement Entity will submit an updated call for tenders to all tenderers who participated in the negotiations, on the basis of which the tenderers will submit new tenders. After this, the procurement procedure continues from point 1 described above based on the new call for tenders.
After the tender comparison has been conducted, the Procurement Entity will:
5. request the winning tenderers to submit reports and other documents related to the suitability requirements
6. make a procurement decision
