Vaasan Sähkö Oy ("The Purchaser") is presently searching for solutions to reduce the use of fossil fuels. A feasibility study has been made for two different heat pump projects. The projects seem profitable. At this stage one of the projects (Pått project) will be materialized.
This contract notice applies to the Pått project. The target is to implement the project in spring 2023. The Purchaser therefore asks for binding quotations for the needed heat pumps.
This document and its appendixes are Invitation To Participate. Preliminary Invitation to Tender and Final Invitation to Tender will be prepared and issued later on during the procurement phase.

Heat pump for Pått-project: In this project the purpose is to use heat pumps to extract heat from purified sand filtered sewage water and produce part of the district heat in this way. The heat pump plant would have a total heat capacity of 9 – 12 MW divided on 2 or more individual, independently operating heat pumps or groups of interconnected heat pumps. The Vaasan Vesi Pått effluent treatment plant is positioned in Palosaari about 2 km north from the city center. The plant uses sand filtration as the final step prior to discharging the water to the sea. The primary solution is to have sewage water directly in the evaporator. In case this is not possible, a closed circuit loop water system will be arranged by the Purchaser.

The Request for Quotation outlines the requirements regarding the design, engineering, materials selection, manufacturing, delivery, erection, commissioning, personnel training, testing and maintenance issues of the heat pump for the project. Also, a proposal service agreement for the periodic annual maintenance of the Heat Pump should be included in the quotation.

This notice is the suspension notification of the compression heat pumps for heat pump project (The Pått project) procurement. According to section 116 § of the Act on public contracts in special sectors (1398/2016), the procurement procedure may be suspended only for a real and justified reason. The provisions of section 114 § concerning the decision on procurement shall apply to the decision to suspend the procurement procedure. According to the draft legislation, in assessing the reason for the suspension, the contracting entity must pay attention to whether the suspension of the procurement procedure is based on real reasons and whether the solution would discriminate against candidates or tenderers. According to the case law the suspension of a procurement procedure has not been considered to be in breach of the rules on public procurement, where the suspension was based on real reasons (ao. KHO 2015 T 861, KHO 2015 T 875). In the case law and legal literature the real reasons have been considered to be among other things, that - a change in the subject of the procurement or the need to procure during the procurement procedure - the invitation to tender has proved to be open to interpretation or error During the procurement process the overall timeline and Project schedule has been changed and the estimated completion will move forward for some months. In the process, Vaasan Sähkö is also going to correct Procurement documentation for the risk of any possible subjects to interpretations regarding the preliminary Project schedule and some technical requirements presented in procurement documents. There is a legitimate reason for suspending the procurement for the reasons mentioned above in the legislation. The solution does not discriminate against suppliers.
