Unified Railway Communication and Application (URCA) Service

In accordance with the decision made by the Finnish Cabinet Committee on Economic Policy in January 2015 Finnish Transport Agency is planning to change railway voice communication network from GSM-R to the authority's existing TETRA network. Change is possible because Finland has got a CCS TSI exemption from European Commission (CCS TSI) in summer 2015. Therefore national regulations will be used and they allow the use of TETRA instead of GSM-R in railway safety related communication. This will not affect to the European railway interoperability because Finland is a railway island in EU (http://www.lvm.fi/en/-/virve-selected-as-radio-system-for-trains-797015). />The Finnish Transport Agency (FTA) invites tenders for URCA (Unified Railway Communication and Application) Service in accordance with Invitation to Tender and its Appendices.
The scope of the procurement is the URCA (Unified Railway Communication and Application) Service, which consists of the URCA system for railways' future proof radio network independent speech communication and the services thereto. The URCA system will form a basis for railways' safety related voice communications and applications. Scope includes also URCA system support services. URCA system also enables connections to the next generation railway radio network (presumably LTE (EPC/IMS)) which will be defined by European Railway Agency ERA.
Scope of procurement, URCA service consists of the following parts:
A. URCA system and project:
— Railway specific communication application (URCA core functionality)
— including needed software licenses.
— Server platform for Railway specific application (Hardware)
— including needed software licenses.
— Interfaces to GSM-R, TETRA, PSTN networks (and also later to LTE, or similar)
— including needed software licenses.
— Voice recording functionality for safety related railway communication
— including needed software licenses.
— URCA subscriber management functionality
— including needed software licenses.
— Network management functionality for URCA system
— including needed software licenses.
— CUI
— 90 fixed CUI's in 22 different train traffic control sites in Finland
— Mobile phone applications
— GUI development
— End-user friendly railway applications and distribution channel to TETRA and public mobile phones
— Chosen optional requirements
B. URCA system support services
— URCA system support services
— URCA system development for the contract period
C. Role-based man day extra work and training
Detailed technical descriptions and requirements of the URCA system can be found from the other URCA procurement appendix documents, particularly at appendices 3 and 4.
In addition, scope of procurement include all deliveries which are needed to deploy parts A, B and C. Requirements concerning the URCA project and deployment are presented at appendix 5 Project time schedule and acceptance period.
The URCA Core is the core of the system. Voice recording, subscriber management and network management functionalities are systems that support the core and there shall be a possibility to replace these systems at a later stage. In addition, scope includes options (Section 2.2), training and development relating to the URCA service.
The project will be followed through using project model and methods presented by the Contractor. The project should meet all the requirements (e.g. schedule) of the invitation to tender. The server platform of the URCA system must be placed in the FTA premises of Helsinki metropolitan area.
Further development subjects after the project in accordance with Invitation to Tender and its Appendices.
As part of the procurement and the deployment project, the Contractor shall arrange the URCA Demo as soon as possible.

The Parties may continue the Contract period by 3 separate 3-year terms upon a mutual agreement made before the end of the respective Contract term. The last 1 of the optional terms may also be shorter than 3 years.

The professional or trade registers.
Requirement:
The tenderer shall be registered in the professional or trade register of its domicile country (i.e. in Finland the Trade Register maintained by the National Board of Patents and Registration of Finland).
The domicile country of the tenderer shall be a country that is a member of the World Trade Organizations Agreement on Government Procurement (GPA). If the tender is made as a group of economic operators this requirement shall be met by each of its members individually. If the tenderer operates outside of Finland but has a branch in Finland the requirement shall be met by in the domicile country as well as in Finland.

Information to be provided by the tenderer:
The tenderer annexes a trade register extract into the tender. The certification shall not be older than 3 months.

Payment of taxes and social security fees and exclusion criteria in the Act on procurement by entities operating in the water, energy, transport and postal services sectors and Act on Public Contracts.
Requirement:
The tenderer and the named subcontractors has fulfilled the obligations relating to the payment of taxes and social security fees by the submission of the request for tender at the latest. They shall also be registered into the Preliminary Tax Registry, Value Added Tax Registry and to the Employee Registry if the Prepayment Act requires it. The contracting authority reserves the right to approve a tenderer with unpaid taxes or fees if the amount of the unpaid taxes or fees is minor or if the tenderer has made a payment agreement relating to the unpaid taxes or fees and has followed the agreement.

The tenderer is not subject to the exclusion criteria as defined in Section 50 of the Act on procurement by entities operating in the water, energy, transport and postal services sectors (349/2007). The contracting authority may also apply the section 54 of the Act on Public Contracts (348/2007). If the tender is made as a group of economic operators, these requirements shall be met by all of the group's members individually.

In addition it is required that the tenderer has taken into account the section 46 of the Act on procurement by entities operating in the water, energy, transport and postal services sectors concerning taxation, environmental protection and working conditions when drawing the tender.

Before concluding the contract the chosen service provider shall provide the information required again if requested by the contracting authority. During the contract period the information shall be provided in every 12 months.
Information to be provided by the tenderer:
The tenderer shall annex the following statements into its tender (or annex Tilaajavastuu.fi — report for the parts 1a to 1c):
1a) A certification by authority or a testimony under oath which states that the tenderer and the named subcontractors have paid all taxes required by legislation and that they are registered into the Preliminary Tax Registry, Value Added Tax Registry and to the Employee Registry if the Prepayment Act requires it (in Finland all the information mentioned above is included in the certificate of paid taxes);

1d) If the tenderer or the named subcontractors have unpaid taxes or social security fees they shall instead of the certificates 1a and 1b submit the certification of paid taxes, payment agreement of unpaid taxes or social security fees and a statement by relevant authority which testifies that the contract has been followed. If the tenderer or the named subcontractors have unpaid pension payments required by legislation the tenderer shall submit instead of the certification required in 1c a certification on the pension fee debt, payment agreement of the unpaid pension payments and a statement by the pension institution that the agreement has been followed.

Economic and financial standing.
Turnover.
The tenderer's turnover shall be in the range of 10 000 000 EUR per year from the preceding 3 financial years. If the tenderer is a group of economic operators the members of the group may fulfil the requirement together.
The tenderer may fulfil this criteria together with its subcontractors. In that case, the contracting authority may require it to prove to the contracting authority that it will have at its disposal the resources necessary, by producing a commitment by those entities / subcontractors to that effect.

The investments required to set up the service and the critical need for the service during the contract period are the basis for this requirement.
The tenderer shall provide information concerning the turnover from the preceding financial years if the tenderer is legally obliged to provide them in its domicile country. If the tenderer does not have an audited accounts from a financial year the tenderer may validate its financial standing by other means approved by the contracting authority.

Subcontracting.
Subcontractors' resources which are listed in the tender shall be available to the tenderer. The tenderer commits to be responsible of the operations of its subcontractors. The subcontractors listed in the tender will be named in the contract. The tenderer's possibility to add and/or remove subcontractors is restricted.

If the tenderer uses subcontractors it shall attach the Appendix 11 Subcontractors into its tender. The tenderer shall provide information about the subcontractors it uses, description on how the subcontractor takes part on the services provided, and how the subcontractors are monitored.

The tenderer shall name all the subcontractors it uses directly to provide the service. The tenderer does not have to name e.g. administrative subcontractors.

The tenderer meet the requirements regarding the service personnel's capabilities.

If the tender is made as a group of economic operators, members of the group may fill the requirement together. If the tenderer uses subcontractors, the tenderer and its subcontractors may fill the requirement together.
The contracting authority may inspect the references.
The tenderer shall provide the information by filling in and submitting the Appendix 9 (Requirements regarding the Service Personnel's Capabilities) attached to the tender. In addition, the tenderer has to attach the expert's CV's to tender.
