HUS Group (thereinafter also "HUS" or "Procuring Entity") calls for tenders for Prefilled Formalin Containers for biopsy, tissue and stool specimen for HUS and HUSLAB.
The safety for operators using Prefilled Formalin Safety Containers must be guaranteed and exposuring to formalin vapor must be prevented by structural properties of Containers. Exposuring must be prevented, for example, with a closed system or a pressure-based solution.
Parallel tenders are accepted. Procuring Entity encourages tenderer to submit parallel tenders should they have more than one safety container product available.
As a result of this procurement HUS selects two (2) suppliers in order of priority with whom it shall sign a contract. Procuring Entity will order and use selected products according to the order of priority described in the future procurement decision. However, Procuring Entity may deviate from order of priority if the selection of Supplier does not contain the product required by Procuring Entity, Suppier has delivery difficulties, Supplier is unable to perform in accordance with the contract, the contract with Supplier has been terminated prematurely and/or if the need of Procuring Entity otherwise requires it.
The supply period is estimated to begin in 2023. The contract is in force for a fixed period of 24 months and thereafter until terminated.
The subject-matter of the procurement and the mandatory requirements of it are described in detail in this call for tenders and its attachments.
Procuring Entity have already submitted a procurement notice about this procurement before on June 22, 2023. However, Procuring Entity suspended the previous procurement process and will now submit this new procurement notice for publication.

It is required that the tenderer is registered in the trade register, the advance tax collection register according to the local regulation and the employer register, as well as the register of VAT payers according to the local Value Added Tax regulation, if the legislation requires registration. The customer can check the registration information. This requirement also applies to the subcontractor whose resources the bidder relies on, as well as to all members of a consortium.

Nopeutettu menettely:

Due to the eForms-changes, the aim of Procuring Entity was to extend the deadline for submitting tenders in the previous procurement process. However, TED rejected the notification regarding to the extension of the deadline. Since it was no longer possible to extend the deadline, the procurement was suspended.

This is the reason why accelerated procedure is now followed as compliance with the 30 days time limit in usual open procedure is not possible in this new process in practice owing to an urgency that is duly substantiated by the Procuring Entity. The urgency is arising from circumstances beyond the control of the Procuring Entity (technical err in previous process). The tendering period is at least 15 days as legislation requires.

Procuring Entity has suspended this procurement because Procurement Entity has received only one tender that meets the requirements of the call for tenders and has therefore not been able to perform an adequate comparison between prices or other characteristics. Therefore, there is a real and legitimate reason for suspending the procurement as intended by the legislation. The solution does not have a discriminatory effect on tenderers.
