Puitesopimusten osalta on esitettävä perustelut 4 vuotta ylittävälle kestolle
The Client has the right to extend the contract for a new fixed-term term (“Option Period”) so that the contract ends on 31 December 2029. The Client notifies the exercise of the Option Period no later than six months before the end of the Actual Contract Period. in which case the total duration of the contract is a total of six (6) years and thus longer than the maximum duration of four (4) years laid down in the Act on Public Contracts.
However, in this Procurement the longer duration of the framework agreement is justified in accordance with the Act on Public Contracts. Producing the services that are the subject of the procurement in a way that best benefits the contracting entity is only possible if the supplier is familiar with the contracting entity's operating practices and needs. It can take up to a year to adopt the policies and needs in terms of time, which is why the continuation of the contract without interruptions or changes of supplier is of great importance to the contracting entity. For this it is important that the contract can be continued with the chosen supplier in the event that the contracting entity deems it necessary to use the option period included in the contract. Changing the supplier of the contract during the time the contracting entity needs the service could be detrimental to the contracting entity and the realisation of the results of the service under the contract. Therefore, the conditions laid down in Section 42(5) of the Act on Public Contracts for a contract period longer than four years of the framework agreement are met.
The procuring entity shall not use the option included in the contract if there is no need for it for the service to be procured. In this case, the contract period is shorter than the four years stipulated in the Act on Public Contracts. In addition, the framework agreement may terminate even before the end of the fixed-term contract period or option period at the time when the service has been acquired at the maximum value specified in the contract, and also in this case the contract period may be four years or less.
No material changes will be made to the terms of the Framework Agreement during its term.
