Gas Chromatography Mass Spectrometer

The procurement covers the purchase, delivery and installation of one (1) gas chromatography mass spectrometer (“GC-MS”) including the computer to control the GC-MS and required software as defined in more detail in Appendix 1 "Description of the Procurement" and in Appendix 1.1 "Technical Requirements". The requirements for the delivery and installation of the GC-MS are defined in the section 7 of the Agreement (Appendix A). In addition, the procurement covers the purchase and delivery of consumables and spare parts and the provision of maintenance services and training for the acquired GC-MS. The consumables and spare parts are defined in more detail in Appendix 1 "Description of the Procurement" and the training is defined in more detail in Appendix 1 "Description of the Procurement" and in section 4.5 of the Agreement. The requirements for delivery of consumables and spare parts are defined in section 7 of the Agreement. AGREEMENT PERIOD AND DELIVERY SCHEDULE The Supplies shall be delivered as described in section 7.2 of the Appendix A "Agreement". After the acceptance of the GC-MS the Agreement shall be valid for the maintenance services, additional training, consumables, spare parts and help desk for a fixed period of five (5) years after which the Agreement shall be valid until further notice. For the sake of clarity, it is stated that the Supplier is committed to provide software updates for the software specified in Appendix 1 for the entire lifetime of the GC-MS purchased under the Agreement. The pricing of such software updates is based on Appendix 2.

The procurement includes, as an option, software updates and 0-4 additional licenses for Wiley Registry/NIST Mass Spectral Library 2023. The pricing of software updates and additional licenses for Wiley/NIST Mass Spectral Library 2023 is set out in the Appendix 2 "Prices". The procurement also includes, as an option, the possibility to acquire other software related to the use of GC-MS than what is described in Appendix 1 "Description of the Procurement". The pricing of such software shall be agreed separately between the parties. Such software updates, additional licenses for Wiley Registry/NIST Mass Spectral Library 2023 and other software shall be delivered based on Luke’s separate orders. Part of the consumables and spare parts are options (marked in Appendix 2 "Prices"). The procurement also includes, as an option, chemical ionization in mass spectrometer. This option is optional to offer for the tenderer. If the tenderer have indicated in its tender that the tenderer offers chemical ionization in mass spectrometer the pricing for the chemical ionization is set out in the Appendix 2 "Prices".

Risk Indicator: Economic or financial requirement and a description of it: The tenderer's economical standing and financial solvency shall be sufficient to provide the products and services covered by the Agreement. A tenderer's economical standing and financial solvency are considered sufficient if the tenderer's risk rating is 1-3 in Suomen Asiakastieto Oy's Risk Indicator. The tenderer's economical standing and financial solvency may also be assessed on the basis of financial statements and/or other reports which may be provided on request and on the basis of information obtained by the contracting authority on its own initiative. A tenderer with a risk rating of 5 in Suomen Asiakastieto Oy's Risk Indicator or whose economical standing and financial solvency are estimated to correspond to risk rating 5, shall be excluded from the procurement procedure. A tenderer with a risk rating of 4 in Suomen Asiakastieto Oy's Risk Indicator or whose economical standing and financial solvency are estimated to correspond to risk rating 4 may be excluded from the procurement procedure if the tenderer is unable to provide a reliable and satisfactory explanation of the measures it will be taking or has taken to improve its economical standing and financial solvency. If the tender is submitted as a group, this requirement applies to all members of the group. If the tenderer uses resource units, all resource units shall meet this requirement in addition to the tenderer

REFERENCE REQUIREMENT 2 The tenderer shall have at least ten (10) hours of experience on repairing gas chromatography mass spectrometer(s). The repairing shall be carried out between 8th of May 2021 and 7th of May 2024. The experience requirements relating to the technical and professional qualifications of the tenderer are set out in more detail in Appendix B "References" of the Call for Tenders. The tenderer shall meet all the reference requirements set for the experience of the tenderer. The tenderer shall complete the "References" form attached to the Call for Tenders in accordance with the instructions and requirements set out therein. The "References" form shall be uploaded as an annex to the tender under the tab "Other terms and conditions" of the eTendering system. If the tender is submitted as a group , the members of the group may meet reference requirements together. If the tender is submitted as a group, the member of the group responsible for submitting the tender shall send the ESPD form in the eTendering system for completion by the other members of the group. See Appendix C "Instructions for ESPD form" of the Call for Tenders. The economic operator is in any analogous situation like bankruptcy arising from a similar procedure under national laws and regulations.

The economic operator is bankrupt.

The economic operator itself or any person who is a member of its administrative, management or supervisory body or has powers of representation, decision or control therein has been the subject of a conviction by final judgment for corruption, by a conviction rendered at the most five years ago or in which an exclusion period set out directly in the conviction continues to be applicable.

The economic operator is in arrangement with creditors.

The economic operator itself or any person who is a member of its administrative, management or supervisory body or has powers of representation, decision or control therein has been the subject of a conviction by final judgment for participation in a criminal organisation, by a conviction rendered at the most five years ago or in which an exclusion period set out directly in the conviction continues to be applicable.

The economic operator has entered into agreements with other economic operators aimed at distorting competition.

The economic operator is aware of any conflict of interest, as indicated in national law, the relevant notice or the procurement documents due to its participation in the procurement procedure.

The economic operator or an undertaking related to it has advised the contracting authority or contracting entity or otherwise been involved in the preparation of the procurement procedure.

The economic operator is guilty of grave professional misconduct.

The economic operator has experienced that a prior public contract, a prior contract with a contracting entity or a prior concession contract was terminated early, or that damages or other comparable sanctions were imposed in connection with that prior contract.

Since the total comparison price is the only award criterion the award criterion number is 100.
