The procurement object is the delivery of machine washable medium-risk pressure relief mattresses with reinforced side walls and evacuation handles to HUS Bridge Hospital, which will open in 2023. As mattress washing at Bridge Hospital will be performed in an automatic bed and mattress washing machine, the washable mattresses must be designed to withstand washing and mechanical chemical disinfection.
The Client will procure to HUS Bridge Hospital approximately two hundred and fifty (250) machine washable medium-risk pressure relief mattressess with reinforced side walls and evacuation handles. The first order, concerning approximately two hundred and fifty (250) mattresses to HUS Bridge Hospital, must be delivered to the Client according to the delivery terms no later than 12.12.2022.
The procurement includes an option for purchasing similar mattresses for the Client’s other hospitals, because the Client is planning to buy an equivalent automatic bed and mattress washing machine for Meilahti Tower Hospital, the future Laakso Multi-Hospital, and Jorvi Hospital during the contract period. As an option the Client is planning to procure approximately 900-1500 machine washable medium-risk pressure relief mattresses with reinforced side walls and evacuation handles.
The quantities given in the call for tenders are based on preliminary assessments made by the Client and are not binding to the Client. The procurement does not include any obligation to purchase a certain quantity or provide the supplier with the sole right to supply the Client with the mattresses that are the procurement object.
The washing program used to wash the mattresses and beds is described in more detail in Annex 2 of the call for tenders “Washing program information and description”.

SUBCONTRACTING

The tenderer may use subcontractors. The tenderer is fully responsible for the work of their subcontractor to the procurement unit. The procurement unit will sign the

contract only with the company responsible for the tender offer.

Any subcontractors used in the procurement execution must be named. Any named subcontractors will be treated as a resource of the tenderer. Therefore, the tenderer must be able to ensure that the subcontractors named in the tender offer will be available for the procurement execution, should the tenderer be chosen. The chosen tenderer must provide all the certificates and reports specified in this form on all the subcontractors participating in the providing of the service before the contract of procurement can be signed.

APPLICATION AS A CONSORTIUM

In accordance with the Act on Public Procurement and Concession Contracts (1397/2016) the companies may put themselves forward as a group (consortium). A consortium means here cooperation of companies in order to win the contract award.

Application as a consortium must be announced in the tender. Every member of the consortium has to be announced in the tender. All of that, what is said in these instructions or other documentation related to this procurement and concerns the tenderer, is applicable also to any consortium, standing as a tenderer, if not mentioned otherwise.

If the tenderer has companies under its control (e.g. belonging to the same corporation), capacities of those companies shall not be automatically assessed as tenderer´s capacities. Should the tenderer invoke this kind corporation capacities, the tender has to be composed as a consortium, so that it includes those companies as members of the consortium (Group) - or as tenderer´s capacity entity.

Consortium has to designate one organization, who is in charge of all communication with the contracting entity during the procurement procedure. However, all the members of the consortium will be signing the contract, and will be jointly responsible for all of the responsibilities of the contract.

Consortium must give a commitment that named members of the consortium are available for accomplishing the procurement, should the consortium be selected. Members of the consortium must provide a written commitment attached to the tender. The contracting entity will evaluate the adequacy of evidence of compliance and verify that the resources will be available throughout the period, covered by thecontract.

RELYING ON THE CAPACITIES OF OTHER ENTITIES

The tenderer must prove to the contracting entity that the requirements relating to economic and financial situation and technical capability as well as other requirements are met. The tenderer has no right to change the tenderer´s capacity entity whose capacities he has put forward in the tender.

If the tenderer invokes the capacities of a subcontractor, the relevant subcontractor must actually be involved in the implementation of the procurement. The invoking tenderer (or group) bears the obligation to authenticate the fulfillment of the requirements set by the contracting entity. Proof must be provided in form of a commitment, which shows that the resources meeting the required conditions are available for the tenderer (or Group). The contracting entity will evaluate the adequacy of evidence of compliance and verify that the resources will be available throughout the period, covered by the contract.

FOREIGN TENDERER

A foreign tenderer must provide the information referred to in the requirements by giving a register extract or other similar certificate stipulated in legislation of tenderer’s country of location, or any other commonly accepted way such, as by giving a statement under oath, or a declaration confirmed with affirmation, in accordance with legislation in country of location.

According to Act on Public Procurement and Concession Contracts subsection 1 of section 125 a procurement procedure may only be suspended for a real and legitimate reason. According to the legislative proposal for Act on Public Procurement and Concession Contracts (HE 108/2016 vp, p. 223) the section 125 will remain as it is in the section 73a in the former Act on Public Procurement (348/2007). According to the legislative proposal for the former Act on Public Procurement (HE 182/2010 vp, p. 22) the contracting entity must draw attention, while evaluating the reason for suspension of the procurement procedure if the suspension is based on a real and legitimate reason and if the decision to suspend will have a discriminatory effect to the candidates or tenderers. In the case law, for example, an acceptable ground for suspension has been that no suitable tenders have been received at all. In the procurement of machine washable medium-risk pressure relief mattresses with reinforced side walls and evacuation handles, there was the only tenderer to submit a tender. After excluding this tenderer from the competitive tendering there are no suitable tenderers, who submitted a suitable tender, left in the competitive tendering that could be selected as a winner. Therefore, the contracting entity states that there is a real and legitimate reason to suspend the procurement and that the decision to suspend the procurement won’t have a discriminatory effect on the tenderers. For these grounds, the contracting entity decides to suspend the procurement of machine washable medium-risk pressure relief mattresses with reinforced side walls and evacuation handles.
