Finnish Customs

Finnish Customs is arranging a tendering competition in order to procure services related to the brokerage of cryptocurrencies, such as Bitcoin. The cryptocurrency brokerage service means execution on behalf of a customer of a sale or purchase of cryptocurrencies on a cryptocurrency platform or market place, or as an OTC transaction.
The cryptocurrency assets have or will be seized by Finnish Customs during the course of its activities, and the assets are subject to binding court orders prior to being sold. In order to sell the assets with the help of a professional broker, Finnish Customs is hereby requesting possible suitable suppliers of cryptocurrency brokerage services to send their request for participation through the link above.
The main aim of Finnish Customs is to make sure the cryptocurrencies are sold in a secure way, preventing further money laundering and criminal activities. In order to accomplish this, a framework agreement will be signed with up to three suppliers. During the contract period, varying individual or annual needs will be subjected to a mini tender, which will be the basis for supplier selection regarding each need.
The estimated total value of the service during the full term of the agreement is EUR 250 000 (VAT excluded), but as there may be more cryptocurrency seizures and as the value of the
Assets tends to change quickly, Finnish Customs expects the full total maximum value of service fees within this framework arrangement to be limited to EUR 2 000 000 (VAT excluded) or less.

The scope of the procurement are brokerage services (including OTC) related to cryptocurrencies. As the currencies are constantly developed, the applicant is expected to be able to cover the most common currencies, such as Bitcoin, Bitcoin Gold, and Bitcoin Cash, and agree to add more currencies to their list if so mutually agreed. The term of the agreement is two (2) years, which may be followed by two (2) optional years. Applicants to the negotiations will be chosen based on their answers regarding e.g. references and quality assurance.

The final and binding bid will be subjected to price and quality criteria, as well as scoring. The estimated weight of quality points is 50-80 %.

Taloudellinen ja rahoituksellinen asema:

1) Tenderer's turnover for year 2020: Minimum EUR 500 000;

2) Adequate professional risk indemnity insurance: the supplier agrees to acquire an insurance, if so required by Finnish Customs and as agreed in detail in the final agreement, in case insurances for cryptocurrency brokerage services are available;

3) Economic standing: Rating Alfa minimum AAA or equivalent.

During the reference period, the tenderer has provided the following services.

Requirement: the tenderer has provided crypto asset brokerage services (as defined in the contract notice) to customers, with the combined value of crypto assets EUR 200 000 000 or more, within the last three (3) years, calculated from the date of publication of this notice. The service has been provided to a customer, the applicant's internal or company group entities are not accepted as customers. The services provided in the reference have complied in addition to generally applicable legislation with possible national legislation concerning crypto asset brokerage services, if applicable.

Please indicate the value, time, country and description of the references.

Additional two points: Experience of OTC (Over the Counter) services, with the combined value of crypto assets EUR 50 000 000 or more. Please indicate the value, time, and description of the references.

Please note that if you refer to a subcontractor's or consortium member's references, a separate ESPD has to be filled in regarding that entity, and you need to submit a clarification with your participation application indicating which part of the crypto asset brokerage your subcontractor/consortium member will be providing to the Finnish Customs.

Please describe how you fulfil the AMLD5 requirements including the following, as implemented in local law, and submit this description with your application:

• maintenance of policies and procedures for risk-based assessment of money laundering and terrorist financing risks relating to the firm’s services and its customers;

• identifying and verifying the identity of the customer;

• keeping records of know-your customer information;

• continuous monitoring of customer information and customer activity;

• identifying the ultimate beneficial owner (UBO) of the customer and recording the UBO;

• application of enhanced know-your customer measures in relation to high-risk customers, remotely identified customers and politically exposed persons;

• policies and procedures for reporting suspicious transactions, including confidentiality obligations relating to such events and the rules not to carry out the transaction.
