The purpose of the procurement is to acquire a transcoding and origin services solution including Just In Time (JIT) packaging. Solution should have modern capabilities and flexibility to manage the processes.
The object is to procure the online video platform for Yle areena as a software as a service (SaaS).
The procurement is divided into two different sections:
1) Transcoding solution
2) Origin services solution.
The tenderer can either offer a solution for one of the sections or a complete solution that includes both transcoding and origin services. Yle shall choose one (1) supplier for each section based on the grounds described in the appendix “Evaluation of tenders”. The selected tenderer can be the same for both sections in case a complete solution that includes both sections is offered and the tenderer is rewarded the highest score on both sections.

Osan nimi: Transcoding solution

Lyhyt kuvaus:

The transcoding service’s main function is to transcode Yle source files for JIT packaging in Origin service. Main goal in transcoding is the quality of video and audio files. Yle has multiple different media formats that require transcoding. In target state, the transcoding platform should ingest a large variety of media files that are common in broadcasting business. When source files have been ingested, main functionalities that Yle wishes from transcoding service are source analysis, per-title encoding, Quality control settings and configuration optimizations to improve quality and efficiency.

The following entities are part of the procurement and apply to both solutions or if a complete solution is offered by the provider, they apply to that as well.

*Implementation project for the SaaS solution

Including all the necessary actions from both Yle and the provider so that the solution is usable and configured for Yle’s environment including necessary licenses, integrations, migrations, configurations, training and ICT infrastructure. User training for Yle Areena core team is part of the implementation project and the training should provide skills for the team to operate the system as required.

Also all mandatory requirements have to be met that are stated in the invitation to tenders requirement document. If transcoding and origin services are provided by different providers, the integration between two solutions are part of the implementation project.

*Maintenance and support of the solution

Yle requires complete maintenance and support within the SLA boundaries that will be described in the final invitation to tender. The support service must contain a service where the Yle Areena Core team can contact people and acquire help for solution related issues.

Uudistusten kuvaus:

The start date of the agreement is an estimate and shall be updated based on the schedule of the procurement process.

The Agreement shall enter into force when both Parties have signed the Agreement and it shall be valid until further notice. Please see the agreement for more information.

The Customer reserves the right to purchase the client side analytics (both segments) during the Agreement period.

Lyhyt kuvaus:

The second solution to be procured is Origin services for transcoded files. The main functionalities for Origin services are Just In Time packaging (JIT) to delivery formats, caching for transcoded files and DRM (Data rights management). Yle wishes that the new solution enables support for modern, emerging audio and video technologies and provides broad functionalities especially for DRM which enables Yle to provide a broader variety of media for end users. Yle wishes that introducing new functionalities in the solution is easy and Yle has control over configurations like packaging rules and manifests.

Vaihtoehtojen kuvaus:

The Customer reserves the right to purchase DRM key management solution and / or the client side analytics (both segments) during the Agreement period.

According to Finnish Act on Public Procurement and Concession Contracts (1397/2016), section 125, a procurement may be suspended for a real and legitimate reason. Furthermore, according to legal praxis it has been accepted as a legitimate reason to suspend the procedure, if enough competition did not emerge, i.e. procurement unit did not receive any proposals that meet the mandatory requirements or received only one proposal.

In this procurement only one of the received tenders was compatible with the call for tenders so no competition was generated. Yle has decided to suspend the procurement procedure in the section 1) Transcoding solution.

According to Finnish Act on Public Procurement and Concession Contracts (1397/2016), section 125, a procurement may be suspended for a real and legitimate reason.

According to legal praxis of the Market Court (e.g. MAO H128/2022 and MAO H315/2021)) and the Supreme Administrative Court (e.g. KHO 27.3.2015/861), a change in circumstances or in the needs of the procuring unit constitute a real and legitimate reason for suspension.

In this procurement Yle’s needs for the procurement have changed due to updates, of which Yle had no prior knowledge, made to Yle's current packaging solution during the latter part of the year 2022.

The changes in circumstances which have reduced the need for the procurement significantly, if not eliminated the need completely, constitute a real and legitimate reason to suspend the procurement within the meaning of Section 125 of the Act on Public Procurement and Concession Contracts. The decision to suspend the procurement procedure does not discriminate against tenderers.
