The contract period is one year (influenza season 2023-2024). The procurement contains three options to extend the contract for the periods concerning influenza seasons 2024-2025, 2025-2026 and 2026-2027.
Estimated quantity for the contract period including options is 464.000 doses. Customer reserves the right to increase or decrease the ordered numbers of doses by up to 20%.
The contract will be awarded to one Supplier based on a comparison of tenders. Tender that is economically the most advantageous will win the competition.

The purpose of STM and the Customer is to procure Live Attenuated Quadrivalent Seasonal Influenza Vaccine (LAIV) belonging to the National Vaccination Programme in Finland. The tendered vaccine must be suitable for children aged between two and six years old.

The Customer will implement the procurement on behalf of STM. The roles of STM and Customer are described in more detail in section "Presentation of the contracting authority".

The subject of procurement and the mandatory requirements relating to it are described in detail in this Call for Tender and its annexes. The contract will be awarded to one Supplier based on a comparison of tenders.

CONTRACT PERIOD

The contract´s duration is one year (influenza season 2023-2024). Estimated quantity for the contract period is 116.000 doses. The customer reserves the right to increase or decrease the ordered numbers of doses by up to 20%.

The Contract period shall enter into force once the contract has been signed, and expire when all contractual duties have been performed. After the contract period, the Customer reserves the right for the option described in section "Description of renewals".

Tenders will be compared in the manner described in section "Grounds for decision" of the Call for Tender.

Kyseessä on hankintalain 136.2 §:n 3-kohdan mukaan tehtävä sopimusmuutos hankintasopimukseen. Hankintalain mukaan hankintasopimukseen voidaan tehdä muutos ilman uutta hankintamenettelyä, koska muutoksen tarve johtuu olosuhteista, joita huolellinen hankintayksikkö ei ole voinut ennakoida eikä muutos vaikuta hankintasopimuksen yleiseen luonteeseen (hankintalain 136.2 §:n 3 kohta). Muutoksen syynä on se, että Euroopan lääkevirasto EMA:n ja Maailman terveysjärjestö WHO:n suositusten mukaisesti nelivalenttisten elävää virusta sisältävien nenäsumutteena annettavien kausi-influenssarokotteiden valmistus lopetetaan ja rokotevalmiste (ja muut vastaavat nelivalenttiset rokotevalmisteet) poistuvat markkinoilta. Tämä kansainvälisten viranomaisten käynnistämän muutoksen taustalla on se, että Yamagata-kehityslinjan influenssa B-virukset ovat odottamattomasti koronapandemian myötä hävinneet väestökierrosta. Tällöin tämä viruskanta rokotteessa on hyödytön ja toisaalta elävää virusta sisältävien rokotteita käytettäessä on vähintään teoreettinen riski siitä, että viruksen kierto alkaa uudelleen rokotteen käytön myötä. Toisin sanoen tämä viruskanta on tämän hetken tilanteessa elävää virusta sisältävässä rokotteessa ennemmin haitallinen kuin hyödyllinen. Rokotteen hankintaa tehtäessä vuonna 2022 tämä kehitys ei vielä ollut ennakoitavissa, sillä monien sittemmin palanneiden virusten kierto oli väliaikaisesti lakannut pandemian myötä. Tuolloin hankittu nelivalenttinen rokotevalmiste on ollut silloisten edellä mainittujen viranomaistahojen suositusten mukainen. Nelivalenttisten rokotevalmisteiden poistuminen markkinoilta ja siten tarve korvata hankittava rokotevalmiste vastaavalla kolmivalenttisella rokotevalmisteella on siten aiheutunut syistä, joihin huolellinenkaan hankintayksikkö ei ole voinut vaikuttaa, ja joita sen ei ole ollut mahdollista hankintaa tehdessään ennakoida.

Muutoksen pääasiallinen syy: Muutosten tarve sellaisten olosuhteiden vuoksi, joita ostaja ei ole asianmukaista huolellisuutta noudattaen voinut ennakoida.

Hankinnan kohde on kansallisen rokotusohjelman mukainen LAIV-rokote, eli elävä heikennetty kausi-influenssanenäsumute lapsille vuosille 2023-2024 ja lisäksi optiot vuosille 2024-2025, 2025-2026 ja 2026-2027. Hankittava määrä on tarjouspyynnön mukainen. Hankittavaa määrää voidaan muuttaa tarjouspyynnön mukaisesti ± 20 %. Sopimusmuutoksen myötä lasten nelivalenttinen nenäsumutemuodossa oleva elävää heikennettyä virusta sisältävä kausi-influenssarokote (Fluenz Tetra) korvataan vastaavalla kolmivalenttisella rokotevalmisteella (Fluenz). Muutoksen myötä hankittava kolmivalenttinen rokote tuottaa nykyisessä epidemiologisessa tilanteessa yhtä laajan suojan kuin vastaava nelivalenttinen rokotevalmiste tuottaisi. Koska muita Suomessa myyntiluvallisia lapsille soveltuvia elävää heikennettyä virusta sisältäviä nenäsumutteena annettavia kausi-influenssarokotteita ei markkinoilla ole – myöskään kolmivalenttisia – muutos ei olisi voinut vaikuttaa tarjousten vertailuun. Nyt tehtävä muutos ei vaikuta hankinnan tai hankintasopimuksen luonteeseen: hankinnan kohteena on yhä lapsille soveltuva Suomessa myyntiluvallinen nenäsumutteena annettava kausi-influenssarokote. Muutoksella ei ole hintavaikutusta.
