FinnHEMS - Increase in Medical Helicopter Capacity

FinnHEMS Lentopalvelut Oy (FinnHEMS Flight Services Ltd), a company organised under the laws of Finland (hereinafter "FinnHEMS", "Customer" or "FHLP") is providing Helicopter Emergency Medical Services (HEMS) at six bases. Operations are expanding and one more HEMS base is scheduled to open October 2022. FHLP needs one more helicopter to guarantee uninterrupted service at seven bases. Three (3) southern bases are equipped with EC135 helicopters, flight crews and medical passengers in the southern area are trained for the type. Three (3) northern bases are equipped with H145 helicopters, flight crews and medical passengers in the northern area are trained for the type. The new base will belong to the southern area. Helicopters are circulated between the bases inside the northern area and the southern area due to the operational reasons.
After evaluation of the current set up of the FHLP helicopter fleet, maintenance arrangements, crew qualifications and competence, only suitable helicopter type for FHLP is EC135 or equivalent helicopter which can be maintained and flown with same training and qualifications as EC135. Southern areas helicopter crews are trained for EC135 and training for any other type qualification would be highly inconvenient and expensive to maintain due to costs of recurrent training for two different helicopter types. Other helicopter types do not able allocation of helicopter capacity on different helicopter bases due to type rating and other requirements such as maintenance approvals.
For the reasons explained above FinnHEMS is launching this public tender process to increase helicopter capacity in the southern bases by procuring one EC135, or equivalent, helicopter with a medical kit installed.

For the reasons explained above FinnHEMS is launching this public tender process to increase helicopter capacity in the southern bases by procuring one EC135, or equivalent, helicopter with a medical kit installed.
The tendered helicopter shall have transferrable maintenance agreement which provides shop repair/overhaul of Engines and Parts on a continuous basis at an agreed upon Flight Hour or cycle based rate.
The Customer selects one (1) helicopter. Selection criteria as stated in the procurement documents.
The Contract signing is estimated in April 2022.

The procurement will take place in compliance with the Act on Public Procurement and Concession Contracts (1397/2016).
No compensation will be payed to tenderers for preparation a tender, presentation or otherwise taking part in the procedure.
The Customer will review the status, configuration and maintenance documentation and agreements of the helicopter by audit on site.
General description of Contract reward process:
1) Opening of Tenders
2) Comparison of tenders and selection of winning tender
3) Verifying the winning tender in accordance with the Request for Quotation
4) Agreeing on an inspection date with the winning tenderer
5) Review and inspection of the tendered helicopter on Tenderer's site
6) If compliant, Contract Decision
7) Rectification and appeal period of 14 days
8) Signing of Contract and guarantee procedure according to the Contract
9) Modification work if any
10) Delivery and payment according to the Contract

The Contracting Entity selects one (1) supplier and concludes an agreement with that supplier. The contract period starts from signing the contract and is valid until the helicopter have been delivered and contractual obligations have been fulfilled by the parties.

The Call for tenders was sent to be published via Hilma-portal 22.2.2022.
After the deadline 31.3.2022 12:00 the Contracting Entity received two tenders.
The tenderers fulfilled the set suitability criteria.
During the review of the tenders and verifying that the helicopter tendered fulfilled the requirements of the Call for tenders, it appeared that all the tenders contained faults that cannot be accepted as such.
One tender clearly did not meet the minimum requirements set for the helicopter. The tenderer was excluded from the bidding procedure by the Contracting Entity’s decision. The decision was notified to the tenderer 31.3.2022.
Other tendered helicopter met the minimum requirements, but the pricing given appeared to be inadequate. The tenderer was given the opportunity to specify the pricing of its tender. Based on the answers the price did not include one essential component.
