The Finnish Immigration Service (hereinafter: “Client”) invites tenders for language analysis services in accordance with this Invitation to Tender and its Appendixes. The Client, subordinate to the Ministry of the lnterior, is the agency that processes and decides on matters related to immigration, residence, refugee issues, and Finnish nationality. Among other things, the Client processes applications for asylum from investigation to decision-making. The estimated number of analyses is 200-300 annually. The number of analyses varies depending for example on the number of asylum seekers, the number of applicants unable to present internationally valid travel documents, and the changes in the human rights situation in various countries. The figures are estimates and are not binding to the Client. The procurement is described in more detail in the Appendices.

Uudistusten kuvaus:

The contract includes two (2) optional years. The Client decides whether or not use the optional years. The optional years can be used one (1) year at a time.

The procurement procedure was suspended by decision MIG-1815157. Grounds for suspension: Due to the ambiguity of the call for tenders, the Contracting Entity was unable to compare the tenders. This is a notice of suspension. A new contract notice for the procurement will be published without delay.

Under Section 125 of the Act on Public Procurement and Concession Contracts 1397/2016, a procurement procedure may only be suspended for a real and legitimate reason. The decision to suspend a procurement procedure shall be governed by the provisions of Section 123 concerning procurement decisions. In assessing the cause of suspension, the Contracting Entity should, in accordance with legislative proposals, pay attention to whether the suspension of the procurement procedure is based on real causes and whether the decision would be discriminatory to the candidates or tenderers. In the case of the procurement in question, it has been found that the compulsory requirement is ambiguous. Due to this ambiguity, the tenderers have not had the opportunity to evaluate their own suitability, which may result in distortion of competition or unequal treatment of tenderers. For the aforementioned reasons, there is a legitimate reason to suspend the purchase. This decision does not discriminate against the tenderers. The procurement proces was suspended prior to the procurement decision by decision MIG-1815157. A new Contract Notice for the procurement will be published without delay.
