Under Section 125 of the Act on Public Procurement and Concession Contracts 1397/2016, a procurement procedure may only be suspended for a real and legitimate reason. The decision to suspend a procurement procedure shall be governed by the provisions of Section 123 concerning procurement decisions. In assessing the cause of suspension, the Contracting Entity should, in accordance with legislative proposals, pay attention to whether the suspension of the procurement procedure is based on real causes and whether the decision would be discriminatory to the candidates or tenderers. In the case of the procurement in question, it has been found that the compulsory requirement is ambiguous. Due to this ambiguity, the tenderers have not had the opportunity to evaluate their own suitability, which may result in distortion of competition or unequal treatment of tenderers. For the aforementioned reasons, there is a legitimate reason to suspend the purchase. This decision does not discriminate against the tenderers. The procurement proces was suspended prior to the procurement decision by decision MIG-1815157. A new Contract Notice for the procurement will be published without delay.
